Case No. 82 of 2025 arising out of Domkol Police Station Case no. 420 of 2025 dated 15.05.2025 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than seven months and accusation against the petitioner reflects that there were recovery of 400 bottles of codeine phosphate & Triprolidine Hydrochloride Cough Syrup from the possession of the petitioner.

Learned advocate also submits that the prosecution has relied upon also 11 witnesses and there is no possibility of the trial being concluded in the near future.

Learned advocate appearing for the State opposes the prayer for bail and submits that one of the accused is absconded.

Having considered the quantum of seizure and the fact that there is no possibility of the trial being concluded in the near future. Accordingly, the petitioner should be released on bail.

As such petitioner namely, Asadul Sk @ Asadul Islam shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional District Judge, 5th Court cum learned Judge, Special Court under N.D.P.S. Act, Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Murshidabad without the prior permission of the learned Special Court.

Accordingly, CRM (NDPS) No. 1612 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
