The State of West Bengal Ms. Debjani Sahu ...for the petitioner Mr. Saibal Bapuli, Ld.APP., Mr. Arani Bhattacharyya ...for the State This is an application wherein petitioner is aggrieved with the inaction on the part of the Court below on the ground that after completion of investigation no one was charge-sheeted and final report vide Bhawanipur Police Station FRT No.52 of 2021 dated 03.06.2021 was submitted before the learned Chief Judicial Magistrate, Alipore, South 24 Parganas on 03.06.2021. Since then about 4 1⁄2 years have already been passed but the Court below has not passed any order regarding acceptance/non-acceptance of that final report submitted by the Investigating Agency before the Court.

Having heard learned Counsel for the petitioner and the State, the instant application being CRR 5058 of 2024 is hereby disposed of with a direction upon the Court below to pass appropriate order in respect of final report submitted by the Investigating Agency vide Bhawanipur Police Station FRT No.52 of 2021 dated 03.06.2021 within a period of 30 days from the date of communication of this order, uninfluenced by any observation made herein.

This order is passed invoking this Court's jurisdiction under Section 529 of the BNSS.
