Affidavit of service and the notice of upgradation filed by the petitioner in Court today be kept with the records.

2.

The petitioner's representation seeking pay in terms of the scheme to be fixed by the State respondent in line with the judgment and order dated February 7, 2024 passed by the Hon'ble Special Bench in WPA 9921 of 2007 in the matter of Utpal Kanti Karan vs. State of West Bengal & Ors. (para 272) is pending consideration before the Secretary, School Education Department.

Learned advocate representing the State respondent is not ready with proper instruction in the matter.

As it appears that the petitioner's prayer is pending consideration before the Secretary, accordingly, the instant writ petition stands disposed of by directing the Secretary, School Education Department to take a decision on the petitioner's

representation strictly in accordance with law laid down by the Court in the matter of Utpal Kanti Karan (supra) at the earliest but positively within a period of twelve weeks from the date of communication of this order.

All consequential steps shall be taken by the aforesaid respondent and other authorities strictly in accordance with the reasoned order to be passed by the Secretary of the School Education Department. 6.

Learned advocate for the petitioner is directed to forward a copy of the subject representation(s) to the aforesaid respondent at the time of communicating the order of the Court.

It will be open for the aforesaid respondent to provide opportunity of hearing to the petitioner or his authorized representative prior to passing the reasoned order, if so required.

Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
