Report filed on behalf of the State is also taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an aged person. A theft took place in his house. He reported this to the police authorities. After this the private respondents, his relatives, have been disturbing the petitioner and even trying to oust him from his own house. Complaint was made before the police, but was not acted upon.

Learned counsel appearing on behalf of the private respondents submits as follows. The private respondents are the sister-in-law, the nephew and the niece of the petitioner. The petitioner is in the habit of picking up trouble with his own relations. It is denied that the petitioner was ever obstructed from entering the house.

Learned senior standing counsel on behalf of the State relies on the report and submits as follows. There is a family

dispute brewing between the private respondents. However, on the complaint of the petitioner a proceeding was initiated under Section 107 of the Code in 2023. On another complaint, a specific F.I.R. was registered being Shibpur P.S. case No. 477 dated 23.12.2023 under Sections 341, 323, 379, 506 and 34 of the Penal Code.

It appears that there exists a family dispute between the private respondents. But, the police had acted on the complaints made by the petitioner.

Therefore, no further order need be passed in this regard. However, the police shall keep a sharp vigil at the locale and ensure that no breach of peace takes place.

With these observations, the writ petition is disposed of. As no affidavit called for, the allegations made are deemed not to have been admitted.
