1. Learned counsel appearing for the petitioner submits that the petitioner is the alleged paramour of the wife of the victim. She was earlier granted anticipatory bail by this Court.

2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. She refers to the statements of witnesses and the post-mortem report. However, she submits that a co-accused being the wife of the alleged victim was indeed granted anticipatory bail by this Court on 12.9.2025 in CRM (A) 2950 of 2025.

3. It is the prosecution case that when the husband came to meet the relative of the wife who was admitted at the hospital, he found his wife in a compromising position with her paramour.

4. It will be for the Court to finally decide whether there is any element of abetment of suicide in this case.

5. However, considering the above and the other materials available in the case diary, the fact that a substantially similar circumstanced co-accused was granted anticipatory bail by this Court and the fact that chargesheet has been submitted, I am inclined to grant anticipatory bail to the petitioner.

6. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall not threaten or intimidate the witnesses. The petitioner shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date and shall attend the Court regularly.

7. Accordingly, the application for anticipatory bail is allowed.

8. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
