The writ petitioner claims that her admission in the course of MD-Anesthesia for the academic session 2022-2023 in one Gouri Devi Institute of Medical Science and Hospital, Paschim Bardhaman was denied.

Mr. Swapan Kr. Datta, learned Senior counsel and the Additional Government Pleader drew attention of this Court at page 16 to the writ petition which is a document issued by the National Medical Commission fixing the procedure for admission. Clause 15 of the said document is quoted below: -

"The last date of admission in Post Graduate Broad Specialty course, as approved by Hon'ble Supreme Court of India, is 2nd December, 2022. The portal for filling in the student details shall remain open till 9th December, 2022. The last date for Post Graduate Super Specialty course as of now is 24th December, 2022."

Mr. Datta further submitted that the course for which the petitioner is an aspirant comes within the meaning and preview of "Broad Specialty course and not "Super Specialty course". Mr. Datta further submitted relying upon a communication issued by the National Medical Commission dated December 20, 2022, the same is taken on record, that for the academic session 2022-2023, the Post Graduate Super Specialty courses have already commenced since October 2022 and this writ petition was filed on December 19, 2022.

Inasmuch as the Clause 15 quoted above would show that the last date of admission in Post Graduate Broad Specialty Course, as approved by Hon'ble Supreme Court of India, had also elapsed on 2nd December, 2022. The relevant portal has also been closed on December 09, 2022.

For the ongoing reasons as discussed, this Court is of the firm view that, this writ petition is devoid of any merit.

Accordingly, WPA 28314 of stands dismissed, without any order as to costs.
