Petitioner is in custody for 135 days and is the husband of the deceased. According to the learned advocate appearing for the petitioner, marriage was solemnized six years ago and the investigating agency on completion of investigation has already submitted charge-sheet.
It has also been submitted that prosecution has relied upon 13 witnesses to prove its case. There is no possibility of evidence completing in near future, as such, the petitioner be released on bail.
Learned advocate for the State opposes the prayer for bail.
I have taken into account the statement of the neighbours and the other attending circumstances. Prima facie, I
am of the view that further detention of the petitioner is unwarranted in the facts and circumstances of the instant case. Accordingly, the prayer for bail of the petitioner is allowed. Petitioner, namely, Anikul Hoque @ Anikul shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Chanchal, Malda. If on bail, the petitioner shall be physically present before the learned court in seisin of the case as and when directed and shall not leave the district of Malda without the prior permission of the learned trial court.
Accordingly, CRM(M) 2738 of 2025 is allowed.
