The matter is of District Jalpaiguri. However, as there is no Circuit Bench today, the parties are agreeable for hearing this matter here in the Principal Bench.

Learned advocate for the petitioner relies upon an order passed by me in similar facts and circumstances on 02.12.2022 in WPA 17234 of 2021. I direct the District Primary School Council (D. P. S. C.), Jalpaiguri to follow the order passed by this court on 02.12.2022 in WPA 17234 of 2021 and the D. P. S. C., Jalpaiguri will reconsider the matter after giving an opportunity of hearing to the petitioner and consider his case for appointment. Such opportunity of hearing is to be given by four weeks

from date of communication of this order and the Chairman, D. P. S. C. shall pass one reasoned and speaking order which is to be served upon the petitioner by two weeks thereafter.

The representation of the petitioner shall also be considered which is at page 32 (Annexure -'P-7') of the writ application by the Chairman, D. P. S. C., though it has been made to the West Bengal Board of Primary Education.

With the above observation and direction this writ application is allowed.
