Bishnupada Mondal v. State Of West Bengal & ORS

04.08.2023 Ct. No. 11 rrc WPA 28443 of 2008 (Bishnupada Mondal Vs. The State of West Bengal & Ors.) The writ petitioner knocked the door of this Court praying for a direction upon the respondents to withdraw and/or cancel the order vide. dated 6th November, 2008 passed by the Chairman, Purba Medinipur District Primary School Council.

The petitioner made an effort to change the name of the Parkalagachhia Fajirchandra Primary School which, in his view, was required to be named as "Parkalagachhia Fakirchandra primary School". He claimed that Fakirchandra established the school. The Chairman perused the deed of gift and from the deed of gift, it did not appear that Fakirchandra gifted the land on which the school was established. The Chairman concerned has passed reasoned order and hence, there is no scope of interference in this writ petition. I am of the considered view that with the passage of time the writ petition has become infructuous.

Consequently, the writ petition is disposed of. There shall, however, be no order as to costs. (Partha Sarathi Chatterjee, J.)
