The petitioner appeared in the 2nd SLST, 2025 and he has been called for interview.

He is aggrieved by the manner in which two of his answers were assessed by the Commission. Prayer has been made to direct the Commission to re-assess the answers.

The petitioner contends that the answer given by him should also be taken as correct.

Learned advocate representing the Commission opposes the submission of the petitioner.

It has been submitted that there is no scope for either re-evaluation or re-assessment of the answers. The Commission has acted in accordance with the answer provided by the expert.

It has been contended that the Court is not an expert body and ought not to pass any order contrary to the opinion of the expert.

It has been brought to the notice about the pendency of an appeal being MAT 30 of 2026 (Swaomi Bhattacharjee vs. State of West Bengal & Ors.) where the same issue as to whether the writ court can direct re-evaluation is pending consideration before the Hon'ble Division Bench.

As the issue is presently before the Hon'ble Division Bench, accordingly, hearing of the writ petition stands adjourned for the time being. 9.

It will be open for the respondents to file affidavitin-opposition within four weeks from date; reply thereto, if any, be filed within a fortnight thereafter.

10. The candidature of the petitioner shall abide by the result of the writ petition.

11. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
