Learned advocate appearing for the petitioners submits that the petitioners have been implicated in connection with the instant case for alleged recovery of 25.100 Kgs. of Ganja. All the petitioners are in custody for 224 days and although the charge sheet has already been submitted, there is no possibility of the trial being concluded in the near future. Learned advocate appearing for the State opposes the prayer for bail and submits that the charges have been framed and examination of witnesses is yet to commence and the prosecution has relied upon also 12 witnesses in order to prove its case.

Having considered the period of detention of the present petitioners, I am of the view that further custodial detention is

unwarranted, as such the prayer for bail of the petitioners is allowed.

As such petitioners namely, Abu Taleb Mondal, Suchitra Baidya and Sumitra Naskar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under N.D.P.S. Act, Howrah.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioners shall not leave the jurisdiction of district of Howrah without the prior permission of the learned Special Court.

Accordingly, CRM (NDPS) No. 1616 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
