22.04.2025 Ct.No.34 b.das Rejected C.R.M. (DB) 591 of 2025 In Re : An application for bail under Section 483 of BNSS, 2023 filed in connection with Khargram Police Station Case No.
of dated 08.07.2023 under Section 364/302/120B of the Indian Penal Code.
And In Re :
Kabirulla Sk.
... Petitioner.
Ms. Minoti Gomes Mr. Ankan Mondal ... for the petitioner.
Mr. Joydeep Roy Mr. Arup Sarkar ... for the State.
The petitioner renews his prayer for bail.
Learned counsel for the petitioner submits that the petitioner is in custody for more than a year and trial is in progress. His further detention is not required. Learned counsel for the State opposes the prayer. I have considered the material on record. The petitioner has been implicated by one of the witnesses in his statement recorded under Section 164 of the Code of Criminal Procedure. Three witnesses have been examined during trial out of whom PW 1 and PW 2 have also implicated the petitioner.
Considering the gravity of the offence and prima facie involvement of the petitioner therein, the prayer for bail is rejected at this stage.
The application for bail is thus disposed of. Case diary be returned.
