Petitioner has filed a representation with the DIG, Murshidabad Range, SP, Murshidabad, SDPO Lalbagh and the Officer-in-Charge, Lalbagh Police Station. The contents of the said representation reflects that the petitioner's husband has been arraigned in connection with Lalgola PS Case No. 895/2024 dated 30.08.2024 under sections 21(C)/29 of the NDPS Act, 1985.

It has been alleged that the husband of the petitioner has been implicated because he refused to pay the amount of Rs. 10,00,000/- and the act is pure misuse of law.

The prayers so advanced in the writ petition was for releasing the accused in connection with

NDPS case. A Special Court is already in seisin of the NDPS case. Investigation of the said case is in progress.

Learned advocate for the state submits since the chemical examiner's report is yet to be received as such the charge sheet could not be submitted. Be that as it may, the present accusations prima facie reflects that the same is for the purpose of circumventing the proceedings of the criminal court. As such I am not inclined to interfere and/or deal with the nature of the prayers advanced.

Accordingly, WPA 28604 of is dismissed.
