For the respondent nos. 3 & 4 This writ petition has been filed complaining of laxity on the part of the respondent no. 4 in taking action on the petitioner's complaint dated January 16, 2024 that had been filed before the said respondent no. 4 against the State Public Information Officer, West Bengal Central School Service Commission.

Upon perusal of the writ application it appears that the writ petitioner had sought for certain information under the Right to Information Act, 2005 (hereafter the RTI Act), but such information had not been provided to the petitioner.

The petitioner pursued the cause by filing another application on July 25, 2023, but the same also remained unresponded.

The petitioner thereafter lodged a complaint appearing at page-19 of the writ petition before the respondent no. 4. On perusal of the said complaint it appears that the subject matter thereof is different than the subject matter of the

applications made before the State Public Information Officer of the West Bengal Central School Service Commission.

In such view of the matter, there does not appear to be any laxity either on the part of the respondent no. 3 or the respondent no. 4.

Since a lot of time has elapsed from the date when the initial application for information had been filed by the petitioner and the petitioner has not yet carried the matter in appeal before the appellate authority, the relief prayed for in the instant writ petition cannot be granted.

However, the petitioner shall be at liberty to file a fresh application under the relevant provisions of the RTI Act before the appropriate authority seeking such information as the petitioner may be entitled to obtain in accordance with law.

The authorities concerned shall be free to provide such information as may be permitted by law.

With the aforesaid observations, the writ petition being WPA 28551 of 2024 is disposed of.

There shall, however, be no order as to costs. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
