The petitioner has sought for compassionate appointment on the ground that his father, Dilip Kumar Majhi, while serving Bharat Sanchar Nigam Limited (in short, BSNL), died-in-harness on 15th November, 2017. The claim for compassionate appointment in favour of the petitioner was made on 5th April, 2018.

BSNL is notified organization under the Administrative Tribunals Act, 1985 as public sector undertaking.

In that view of the matter, all service related disputes are to be agitated before the appropriate Administrative Tribunal in view of the provisions of Sections 15 and 28 of the Administrative Tribunals Act, 1985.

The writ petition, as such, is dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum on the self-same ground.

The time spent between 28th November, 2024 when the writ petition was filed and today (03.03.2025) shall be construed to be time spent in prosecuting a litigation bona fide before a court without jurisdiction. (Arindam Mukherjee, J.)
