Petitioner contends he had no role to play in the issuance of a fake birth certificate. He prays for anticipatory bail. 2.

Learned Advocate for the State opposes the prayer for anticipatory bail.

We have considered the materials on record. A fake birth certificate is alleged to have been issued by the local panchayat authorities. Statements of witnesses show petitioner facilitated in obtaining the fake birth certificate against valuable consideration. The fake certificate has already been seized and there is nothing on record to show that the forged document was utilized for wrongful gain.

Under such circumstances, we are inclined to grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the petitioner viz., Partha Sarathi Mondal @ Partha Mondal be Signed By :

released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition petitioner shall cooperate with investigation including handing over specimen signature and handwriting for verification. He shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
