Case No. 17/2025 dated 28.01.2025 under Section 6 of the POCSO Act, 2012.

Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 1 year and the evidence of the vital witnesses including the victim are over. I have taken into account the deposition of the victim before the learned Special Court as also the case diary wherein the medical report has been referred to by the learned advocate appearing for the State. On an assessment of the overall facts including the deposition of the victim girl as well as the other

materials on record, I am of the view further detention is unwarranted.

As such the prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Shibnath Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge, POCSO Court, Barasat.

If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of 24 Parganas (North) without the prior permission of the learned Special Court. Thus, CRM (M) 2692 of 2025 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
