The petitioners have prayed for an order directing the learned Civil Judge (Junior Division), 3rd Court, Tamluk to dispose of Title Suit No.121 of 2022 expeditiously.

Record reveals that an application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure is pending.

By an order dated 14th June, 2024 the learned Trial Jude fixed 24th July, 2024 for hearing of the injunction application and the defendant nos. 1 and 2 were directed to file their written objection to the injunction application in the meantime.

Since the injunction application is pending, this Court is not inclined to pass any direction for expeditious hearing of the suit at this stage. Taking note of the fact that directions were passed for filing written objection to the injunction application and the date was fixed for hearing of the

injunction application,, CO 4114 of 2024 is disposed of by requesting the learned Civil Judge (Junior Division), 3rd Court, Tamluk to take up the hearing of the injunction application on the next date fixed, if the same is otherwise ready for hearing, and to dispose of the same as expeditiously as possible and preferably within a period of three months from the next date fixed for hearing of the injunction application without granting any unnecessary adjournment to either of the parties.

There will be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
