Learned counsel appearing on behalf of the petitioner submits that other than the statements of a co-accused, there is no other material available to implicate the present petitioner. Learned counsel appearing on behalf of the State files a report, which is taken on record. He submits that proclamation has already been issued against the present petitioner. There are also telephonic conversations available as made between the present petitioner and the driver of the vehicle in question/co-accused at the relevant time.

Considering the above, the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
