The instant revisional application has been filed at the behest of one of the accused in G.R. 714 of 2018 arising out of Petrapole Police Station Case No. 66 of 2018 dated March 31, 2018 under Sections 420/464/465/468/471 of the Indian Penal Code and under Section 14 of the Foreigners Act pending before the learned Additional Chief Judicial Magistrate, Bongaon, North 24 Parganas.
It is submitted by the learned Advocate for the petitioner that the case pertains to March, 2018. Charge sheet was submitted in the year 2018. Police copies were supplied to the accused persons. Since then the case has been fixed for various reasons before the learned jurisdictional court. Charges are yet to be framed. The case was last fixed on June, 7, 2024 when it could not be taken up due to resolution by the local Bar. It is now fixed for appearance of the accused persons on March, 17, 2026.
Having heard the learned Advocate for the petitioner and going through the materials on record including the copy of the order sheets annexed therewith, it appears that the charge sheet in the case was submitted in the year 2018 and police copies were supplied to the accused. Since then the case has been fixed before the learned Trial Court for various reasons.
From the copy of the order sheets, it appears that for the last few days the case has been fixed for appearance of the accused persons, in default of issuance of warrant of arrest. It is submitted by the learned Advocate for the petitioner that the petitioner has been attending Court regularly and he has been
prejudiced by delay in disposal of such case. In the facts and circumstances of this case as noted above, it would be appropriate to request the learned Additional Chief Judicial Magistrate, Bongaon, North 24 Parganas, to try and dispose of the G.R. Case No. 714 of 2018 as early as possible without granting any unnecessary adjournments to either of the parties.
No doubt, learned Magistrate shall take all steps to secure attendance of the accused persons, if any, in accordance with law. With such observation, the revisional application CRR 5317 of 2025 is disposed of.
