1. The writ petitioner has filed this writ petition praying for direction upon the respondent to allow the writ petitioner to participate before the selection process of recruitment of primary teachers in the District of Malda in respect of vacancy arising in the year 2006 along with other sponsored candidates by the Employment Exchange which was scheduled to be held on 27.12.2009 or any subsequent date together with other reliefs.

2. It is the contention of the petitioner that he was enrolled in the Malda Employment Exchange as an OBC candidate in the year 1990 and he heard from the reliable source that some recruitment for the post of primary teachers of 2006 was to be commenced or started by the Council from the Malda District and since his name has not been sponsored by the Malda Exchange Office, he prays for allowing him to appear as a prospective candidate with other sponsored candidates

for the post which was going to be held on 27.12.2009.

3. At the time of admission, no interim protection was granted. However, the writ petitioner has been allowed to appear in the examination vide order dated 11.01.2010 and the direction was also passed to file affidavit-in-opposition and reply thereto.

4. However, no affidavit-in-opposition or reply had been filed by the parties.

5. Considering the nature of prayer and long pendency of this case and sixteen years have already been elapsed, this Court seems either the writ petitioner's grievance has been solved or he abandoned his further prayer.

6. In view of the above facts, the instant writ petition became infructuous.

7. Accordingly, the instant writ petition being W.P.A. 23433 of 2009 is, thus, dismissed without any order as to costs.

8. Connected applications, if any, are also, thus, disposed of.

9. Parties to act on the server copy of this order duly downloaded from the official website of this Court.

10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
