In response, the learned advocate appearing for the Kolkata Municipal Corporation submits that the petitioner has constructed two additional floors (the 4th and 5th floors) beyond the sanctioned plan. The Corporation has already issued a stop work notice; however, no demolition proceedings have been initiated thus far.

In light of the above, I find no justification to keep this writ petition pending.

Accordingly, WPA 28554 of 2024 is disposed of without the issuance of any further orders.

It is clarified that the Kolkata Municipal Corporation shall be at liberty to deal with the unauthorised construction, if any, at the said premises in accordance with the law.
