APP Mr. Sujan Chatterjee ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner was arrested on the basis of the statement of a co-accused from whom 100 bottles of phensedyl were recovered. Learned advocate also submits that the petitioner surrendered on 04.11.2025 after his anticipatory bail was rejected on 04.11.2025 and is in custody for about 45 days. Learned advocate for the State opposes the prayer for bail and submits that the prayer for anticipatory bail was rejected with the observations that the petitioner happened to be the kingpin.

I have taken into account the materials appearing in the case diary which do not reflect any recovery from the present petitioner.

However, there are statement under section 161 of the Cr.P.C. so far as the present petitioner is concerned from the local witnesses also.

Be that as it may, having regard to the fact that there has been no recovery, I am of the view that further detention of the present petitioner is unwarranted. Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Bhabesh Ch. Mondal @ Bhabesh Chandra Mondal shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Judge under NDPS Act, Nadia at Krishnagar.

If on bail, the petitioner shall make himself physically available on each and every date of the trial so fixed by the learned trial court/Special Court and shall not leave the district of Nadia without prior permission of the learned Special Court/trial court.

Accordingly, CRM(NDPS) 1623 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
