Kausik (Rejected) CRM (NDPS) 1675 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 376 of 2025 dated 08.03.2025 under Sections 21(c)/27A/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that the subject matter of recovery is 307 Gms. of Brown Sugar and the petitioner is in custody for about 10 months. Charge sheet has already been submitted, but there is no possibility of the trial commencing as the other accused person is absconding.

On the other hand, learned advocate for the State opposes the prayer for bail of the petitioner and submits that proclamation order has been issued against the absconding accused.

As such the prayer for bail of the petitioner is rejected.

Learned Trial Court would exhaust the process of law and if required split up the trial of the case. Petitioner would approach this Court after the examination of seizure list witness is over.

Accordingly, CRM (NDPS) 1675 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
