Kausik (Rejected) CRM (M) 2693 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Rahara Police Station Case No. 335 of 2024 dated 22.10.2024 under Sections 126(2)/127(2)/143/144/95/96/98/61(2)/64/3(5) of the BNS, 2023 read with sections 4 and 17 of the POCSO Act, 2012 and sections 3/4/5/6/7 of the Immoral Trafficking (Prevention) Act, 1956.

Learned advocate appearing for the petitioner submits that petitioner is a lady who is innocent and has been falsely implicated in connection with the instant case and unlawfully detained for a period of 560 days. Charge sheet has already been submitted. As such, the petitioner may be released on bail.

Mr. Das, Learned APP appearing for the State submits that statements of the victim have been recorded under Section 164 of the Cr.P.C. There is specific role of the present petitioner

in collecting and obtaining the girls for alleged offences. Some of the girl(s) is minor girl.

Having considered the accusation against the petitioner which is primarily for carrying out flesh trade, I am of the opinion that this is not a fit case for releasing the petitioner at this stage.

Mr. Sagar Saha, learned advocate empanelled with the High Court Legal Aid Services Authority is directed to represent the victim. His appearance may be regularized by the concerned authority.

In view of the observations made above CRM (M) 2693 of 2025 is dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
