Since the primary prayer of the petitioner is for expeditious disposal of the case being GR 2641 of 2020 pending before the learned Magistrate, 7th Court, Howrah, the matter may be taken into consideration without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case.

Learned counsel for the petitioner submits that the petitioner filed an application before the learned Magistrate on 21st September, 2020 praying for calling for a report from the investigating officer with regard to the vehicle bearing registration no. WB-20U-3378. The application was disposed of by the learned Magistrate on the same date by calling for a report as sought. Though the report has not been submitted till date, charge sheet has been submitted and copies of documents under Section 207 of the Code of Criminal Procedure supplied to the petitioner. Learned counsel submits that the case is not being proceeded with on the ground that the petition dated 21st September, 2020 is pending whereas the said petition has already been disposed of on the same date, i.e. on 21st September, 2020. In view of the above, the learned Magistrate is directed to take the proceeding to its logical conclusion as expeditiously as possible, without granting any unnecessary adjournment to either of the parties, in accordance with law.

CRR 5092 of 2024 is disposed of.
