1. Heard the parties through their respective learned counsels.

2. The petitioner in the instant case is the intending operator who has already applied for a permanent stage carriage permit for the route from Garia Nayabad Bus Terminus to Kolkata Station having a route length of 27 KM.

3. On 20.9.2024 an offer letter was issued by the Regional Transport Authority.

4. Thereafter the petitioner made a representation on 24.9.2024 annexing the relevant documents before the Secretary, Regional Transport Authority for issuance of a permit for the said route. The petitioner submits that despite such representation made before the Secretary, an offer letter was

received from the authority concerned but the Regional Transport Authority, refused to issue any permit without obtaining any NOC from the State Transport Authority.

5. Being aggrieved by the same the petitioner made a representation on 12.12.2024 for issuing permanent stage carriage permit which remains pending for consideration.

6. The petitioner further submits that for the same routes other intending operators have already been granted the permit from RTA Kolkata region without submitting any NOC before the authority concerned.

Learned counsel appearing for the State respondent vehemently opposes such contention of the petitioner and submits that until and unless NOC is submitted by the petitioner, permanent stage carriage permit cannot be granted for the said route as the same route is not covered under the said permit.

8. The petitioner also suppressed the fact that an offer letter for the said vehicle was earlier issued in favour of the petitioner by the STA West Bengal for a different route (Sonarpur 3D Bus Stand to Bagnan Bus Stand).

Having heard the parties based on the available records I direct the Secretary, Regional Transport Authority to consider the representation dated 8.8.2025 within a period of 60 days by passing a reasoned order in accordance with law upon affording an opportunity of hearing to the petitioner and other interested parties, if any, and communicate the said decision to the parties within one week thereafter.

10. With the above observations and directions, the writ petition stands disposed of without expressing any opinion on the merits of the case.

11. There will be no order as to costs.
