Learned advocate appearing for the petitioner submits that inspite of the order dated 03.07.2023 passed by the Sub-Divisional Officer & Tribunal Officer, Maintenance Tribunal, South 24 Parganas, Alipore. Petitioner has not been able to enter her residence till date. The writ petition was filed in the year 2023. Report submitted by the State was prepared on 13.12.2023. The police report reflects that the petitioner was present at the residence along with one of her daughter.

However, the said factum is disputed by the learned advocate appearing for the petitioner. In view of the nature and purpose of the legislation for which the SDO & Tribunal Officer has passed the order in favour of a senior citizen, I direct that the Deputy Commissioner of Police, In-Charge of Garfa Police Station will ensure that in case there is any violation of the order

dated 3.07.2023, in that case necessary steps be exercised by his good office to implement the said order dated 03.07.2023 passed by the learned Sub-Divisional Officer & Tribunal Officer in connection with Maintenance Tribunal Case M-24/2021 to ensure that the present petitioner is able to enjoy peaceful possession and enjoy the residence which was the principal subject matter before the learned Tribunal.

With the aforesaid observations WPA 27294 of 2023 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report without enclosures be handed over to the learned advocate for the petitioner. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
