Case No.459 of 2025 dated 12.07.2025 under Sections 21(c)/22(c)/23(c)/27A/29 of the NDPS Act. And In the matter of:

Majdur Sarkar @ Md. Majdur Molla ... petitioner Mr. Kaushik Choudhury Mr. Dwaipayan Panda ... for the petitioner Mr. Anupam Dasadhikari Mr. Shantanu Talukdar ... for the State Report filed by the State is taken on record. Learned counsel for the petitioner submits that other than the statement of a co-accused, there is no material available against the present petitioner.

Learned counsel for the State opposes the prayer for anticipatory bail, relies on the case diary and the report and submits that in an earlier case where the petitioner was implicated, he was finally acquitted from the charges. There are phone call records between the petitioner and the principal accused at the relevant time.

Considering the above, the other materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
