1. Learned senior counsel appearing for the petitioners submits as follows. The victim was the Teacher-in-charge of the school. The petitioners were the Assistant Teachers there. While the incident took place on 2.9.2025 and the FIR was lodged on 3.9.2025, it was alleged in the FIR that on 9.7.2025 the petitioners along with another levelled allegations of misappropriation of Mid-day-Meal funds against the victim. First, there is no proximate link between the alleged hurling of allegations and the death of the victim. Secondly, making mere allegations regarding misappropriation of funds, can hardly amount to abetment of suicide. Charge-sheet has been submitted.

2. Learned counsel appearing for the State strongly opposes the prayer for anticipatory bail. He submits that the BDO concerned had actually asked the TCI to shift mid-daymeal from one school to another. The present petitioners and others needlessly escalated this issue to level allegations against the victim. Money was also demanded.

3. It will be for the Courts to finally decided if there is any element of abetment of suicide in this case.

4. However, considering the materials available in the case diary including the post-mortem report of the statements of witnesses and the fact that charge-sheet has been submitted, I am inclined to grant anticipatory bail to the petitioners.

5. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall not threaten or intimidate the witnesses. The petitioners shall surrender before the jurisdictional Court and pray for bail within four weeks from date and shall regularly attend the jurisdictional Court.

6. Accordingly, the application for anticipatory bail is allowed.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
