Learned advocate appearing for the petitioner submits that the petitioner along with others were implicated in connection with the instant case for recovery of 20.8 kgs of ganja. Petitioner is in custody since then for a period of ten months, although, charge-sheet has been submitted but till date charges have not been framed.

Learned advocate for the State opposes the prayer for bail of the petitioner and submits that earlier the prayer for bail of the petitioner was rejected. There are other accused persons who are absconding; as such the case cannot progress. I have taken into account the issue of last rejection and about three months have passed since then. Having considered that there is no progress in the case and the prosecution is to

examine 21 witnesses, I am inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner is allowed. As such, petitioner namely, Ramjan Sk @ Ramzan Sk shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Court under NDPS Act cum Additional District & Sessions Judge, 12th Court, Alipore, South 24 Parganas.

If on bail, the petitioner shall be physically present on each and every date so fixed before the learned Special Court and shall not leave the jurisdiction of district of South 24 Parganas without the prior permission of the learned Special Court.

Accordingly, the application for bail being CRM (NDPS) No. 1626 of 2025 is allowed.
