The petitioner is aggrieved by the inaction on the part of the Bhatpara Municipality in releasing the payment on account of the work performed by the petitioner.

Learned advocate representing the Municipality submits, upon instruction that, the prayer of the petitioner will be considered.

In view of the above, the instant writ petition is disposed of by directing the Board of Councillors, Bhatpara Municipality to take a decision with regard to the bills raised by the petitioner on account of the work performed by the petitioner in terms of the work order issued by the Municipality.

An opportunity of hearing shall be provided to the petitioner to produce all documents in support of the work performed.

A decision shall be taken in the matter at the earliest but positively within a period of twelve weeks from the date of communication of this order.

If any amount is found due and payable, the same shall be disbursed in favour of the petitioner immediately thereafter.

It is made clear that the Court has not entered into the merit of the claim of the petitioner and all points are left open to be decided by the Municipality at the time of consideration of the bills of the petitioner. Supplementary affidavit filed by the petitioner in Court today is taken on record.

Writ petition stands disposed of.

Urgent certified copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
