Learned advocate appearing for the petitioner submits that the petitioner is similarly situated as the other accused person who has been granted bail in CRM (NDPS) 1457 of 2025. Records reflects that there is recovery of 5.23 kgs of codeine phosphate. Petitioner is in custody for more than a year and as such on any stringent conditions prays for bail. Learned advocate for the State opposes the prayer for bail and is unable to distinguish the locus of the present petitioner from the other accused person who has been released on bail.

In view of the aforesaid, further detention of the present petitioner is unwarranted. Accordingly, prayer for bail of the petitioner is allowed.

As such, petitioner namely, Nazima Bibi shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge under NDPS Act cum Additional District & Sessions Judge, 4th Court, Alipore, South 24 Parganas.

If on bail, the petitioner shall be physically present on each and every date so fixed before the learned Special Court and shall not leave the jurisdiction of district of South 24 Parganas without the prior permission of the learned Special Court.

Accordingly, the application for bail being CRM (NDPS) No. 1627 of 2025 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
