1. Petitioner is in custody for over 2 years. He contends he has been falsely implicated.

2. Learned advocate for the State opposes the bail prayer.

3. We have considered the material-on-record. A vehicle was intercepted by the police personnel containing narcotics i.e., 3000 bottles of phensedyl linctus syrup. Petitioner is the owner of the vehicle. Trial has substantially progressed. 12 out of 14 witnesses have been examined.

4. In the light of the aforesaid facts and the restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner either on merits or on the ground of delay, at this stage.

5. CRM (NDPS) 1884 of 2024 is rejected.
