The petitioner is aggrieved by the excessive and exorbitant hike in the annual valuation of the subject property.

An objection challenging the hike is pending consideration before the West Bengal Valuation Board. None represents the valuation Board or the Municipality despite service.

As it appears that the objection of the petitioner is pending consideration for a considerable period of time, accordingly, no useful purpose will be served by keeping the writ petition pending.

The same is disposed of by directing the West Bengal Valuation Board being the respondent no. 2 herein to consider the representation filed by the petitioner in accordance with law after affording an opportunity of hearing to the petitioner and the representative of the Maheshtala Municipality and pass a reasoned order and communicate the same to the petitioner as well as the Municipality immediately

thereafter. Prior notice of hearing shall be given to the petitioner and the Municipality.

Decision shall be taken in the matter at the earliest but positively within a period of twelve weeks from the date of communication of this order. Learned advocate for the petitioner is directed to forward copy of the writ petition along with all annexures to the respondent no. 2 at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
