Learned Counsel appearing on behalf of the petitioner submits as follows. De facto complainant has alleged that although he had purchased the property in question, subsequently a forged deed was prepared with the present petitioner being mentioned therein as a witness. The petitioner has been falsely implicated in this case. 2.
Learned Counsel appearing on behalf of the State opposes the prayer for anticipatory bail. However, he submits that although the de facto complainant claimed ownership over the land in question, records show that the patta in respect of the said land was granted in favour of the accused. One wonders why then the accused would prepare a forged deed.

Considering the above, the materials available in the Case Diary and the existence of a dispute as to whether the
land in question is a patta land granted in favour of the accused or owned by the de facto complainant and the alleged role ascribed to the present petitioner, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner shall report before the Investigating Officer once a fortnight till submission of report in final form and shall not threaten or intimidate witnesses.

The application for anticipatory bail is, thus, allowed. 6.
The personal appearance of the Investigating Officer is noted and is dispensed with.
