Learned advocate appearing for the petitioners submits that the learned Civil Judge (Junior Division), 1st Court, Barasat directed the Officer-in-Charge, Baguiati Police Station to see that the order of injunction passed by the said court is maintained in its letter and spirit.

Records reflect that the order of injunction restrained the defendants from dispossessing the plaintiffs from the scheduled property without due process of law.

Petitioners and the private respondents are still in their respective possession. As such police

authorities have no scope to interfere. However, since both the parties are at loggerhead, police authorities have taken steps.

Report submitted by the state reflects that on repeated occasions police authorities have informed regarding the order passed by the civil court. That the same being done, no interference is required by this court.

However, as the petitioner and the private respondents are at loggerhead, I direct the Officer-inCharge, Baguiati Police Station to keep a strict vigil and to ensure that no breach of the peace takes place at the locality and/or any untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations WPA 28788 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioners and the respondents.
