A direction to secure expeditious disposal of Title Suit No. 728 of 2017 pending before the learned Judge, 8th Bench, City Civil Court, Calcutta, is the ultimate relief sought for in this case.

As per submission disclosed by the petitioners that there is no regular Presiding Officer posted with respect to 8th Bench, City Civil Court, Calcutta. Petitioners have been suffering ad interim order of injunction, and steps have also been taken to vacate the interim order apart from the separate prayer for rejection of a plaint. All such interlocutory applications are pending.

It is also clear that till date no appropriate exercise has been taken from the end of the petitioners by making an appeal to the learned Chief Judge, City Civil Court, Calcutta for withdrawing the case to any other available Bench for the regular Presiding Officer not being posted at the moment.

That being the positing, the revisional application is disposed of giving liberty to the petitioners to make

adequate exercise in the form of request of appeal to learned Chief Judge, City civil Court, Calcutta for redressal of the grievance mentioned hereinabove. Parties are directed to make communication of this order to the learned Court below.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
