Petitioner is aggrieved by the fact that in spite of an injunction order being passed by the learned Civil Judge (Junior Division), 6th Court, Alipore in T.S. No. 1569 of 2024 the private respondents had been violating the said order and in spite of informing the police authorities no steps have been taken.

It has been submitted that Maheshtala PS Case No. 511 of 2024 dated 09.10.2024 was registered for investigation and at the stage when the petitioner approached this Court, the investigation of the said case was in progress. Learned advocate for the State submits that for breach of a civil court's order petitioner would better be advised to approach the Civil Court for necessary directions.

Be that as it may, since the investigation commenced in the month of October, 2024, I direct that the investigating authority would take the investigation to its logical conclusion, provided the same has not been completed, in the meantime, at the earliest. Since a civil suit is pending, there is every possibility that the petitioner and the private respondents are in strained relationship. Accordingly police authorities would interfere only if there is violation of law and order.

With the aforesaid observations WPA 28670 of 2024 is disposed of.
