For the petitioner The petitioner has challenged the investigation relating to Serampore P.S. Case No. 84 of 2023 dated 1.3.2023 under sections 419/420/467/468/471/120B/34 of the IPC. The said case is presently pending before the ld. ACJM, Serampore. The investigation of the case is in progress.

Mr. Mazumdar, ld. advocate for the petitioner, submits that the petitioner was served with a notice under section 160 of the Cr.p.c. However, there are no materials appearing against the present petitioner and he has been vindicated by the police authorities pursuant to the orders being passed under Article 226 of the Constitution of India in different sets of proceedings.

Be that as it may, the investigation of the case is under progress. The petitioner would cooperate with the

investigating agency. If there are materials, the petitioner would be at liberty to bring the same to the notice of the investigating agency, if he is called for. No interference is made in this revisional application, at this stage. However, the petitioner would be at liberty to approach this court after report under section 173 Cr.P.C. is filed before the ld. jurisdictional court.

With the aforesaid observations, CRR 4684 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.
