The present writ petition has been filed inter alia complaining inaction on the part of the municipality in taking steps as regards the complaints of illegal and unauthorized construction lodged by the petitioner on 16th September, 2025. The petitioner would complaint that though the petitioner had lodged a complaint with the municipal authorities way back in September, 2025, the municipal authorities have failed to take any steps as regards the illegal construction at premises No. 17, Mayurbhanj Road, P.S. Ekbalpore, Kolkata 700023 within ward No. 78.

The municipality is represented.

Having heard the learned advocates appearing for the respective parties and noting that complaint has been made, I am of the view that the municipality must dispose of the representation

WPA 28374 of 2025 made by the petitioner by carrying out an inspection and by passing a reasoned order. If on the basis of the complaint made, any new or fresh construction is noted to have been made, appropriate steps shall be taken in accordance with the KMC Act, 1980.

With the above observations and directions, the writ petition is disposed of.
