1. The alleged contemnor, Moumita Parveen, Pradhan of No.6, Bagichapur Gram Panchayat is present in Court in answer to the Rule.

2. The panchayat authorities have complied with their portion of the order to the extent that they have found that there is an unauthorized construction. However, on query in came to the knowledge of the panchayat authorities that a suit was filed by the person responsible for the unauthorized construction being Title Suit No.58 of 2018.

3. It is submitted that there is an order of status quo with regard to the nature and character of the suit property.

4. Accordingly, the contempt application is disposed of. Contempt proceeding is dropped.

5. Personal appearance of the alleged contemnor is dispensed with. Rule is discharged.

6. However, the records of these findings shall be sent to the Sub-Divisional Officer as per the West Bengal Panchayat Act, 1973. The petitioner/applicant will be at liberty to approach the civil court and pray for vacating, variation and/or modification of the order.

7. On the basis of the order of the civil court, consequential steps shall be taken.

8. Parties are directed to act on the basis of the server copy of this order.
