This is an application for expeditious disposal of Misc. Case No. 12 of 2021 arising out of an application under Section 125 of the Cr.P.C. filed by the petitioner pending before the Learned Judicial Magistrate, 2nd Court, Barrackpore.

It is submitted by the learned advocate for the petitioner that marriage of the parties was registered on 5th May, 2008 under the Hindu Marriage Act and out of the wedlock a female child was born on 25th February, 2012. The petitioner was tortured by her in-laws for demand of dowry and abused her with filthy languages. She was compelled to make a written complaint before the local gram panchayat which was later

resolved. The opposite party is having extramarital affair and deserted the petitioner and her child. Finding no other alternative, the petitioner filed an application under section 125 being no. Misc. case 241 of 2013 where the petitioner was granted interim maintenance of Rs. 6000 by an order dated 21st April, 2014. Thereafter the case was dismissed for nonprosecution in the year 2019. The petitioner on September, 2021 filed an application under section 125(3) Cr. P.C. and the learned court below granted several adjournments. The next date of hearing has been fixed on 1st April, 2023.

Under such circumstances, petitioner has prayed for expeditious disposal of the case.

In view of such circumstances, the instant revision is disposed of directing the Learned Court below to dispose of the case as expeditiously as possible.
