1. The instant revisional application has been filed by the wifepetitioner seeking a direction upon 9th Judicial Magistrate, Alipore, to adjudicate and dispose of pending application for enhancement of maintenance filed on behalf of the present petitioner, being case no. ACM-475/21, T-R 40 of 2021.

2. It is submitted by the learned advocate for the petitioner that an order of maintenance was passed in favour of the petitioner in an appropriate proceeding in February, 2013.

3. Later on, by filing ACM-475/21, the petitioner sought an enhancement of the maintenance awarded in the year, 2013. Learned advocate for the petitioner submits that the said petition is pending for a considerable period of time since, 2021.

4. Having heard the submissions made by the petitioner and upon going through the copy of the order sheet annexed with the application it transpires that the petitioner has filed ACM-475/21, seeking enhancement of the amount of maintenance as awarded in her favour. The said application was filed in the year, 2021. Record reveals that the opposite party in the proceeding being ACM-475/21, has already submitted its written objection.

5. Nevertheless, the proceeding has not been considered and disposed of till date.

6. Therefore under the aforesaid circumstances it would be appropriate to request 9th Judicial Magistrate, Alipore, South 24 Parganas to try and dispose of the proceedings under Section 125 of the Code of Criminal Procedure, being ACM-475/21, as early as possible without granting any unnecessary adjournments to either of the parties.

7. With the above observation this revisional application being CRR 5339 of 2025 stands disposed of.

8. Photostat certified copy of this order, if applied for, be furnished expeditiously.
