Learned advocate appearing for the petitioner submits that from the joint possession of the petitioner and others more than 125 Kgs. of Ganja were recovered.

Additionally it has been submitted that the investigation is completed, charge framed and the petitioner is in custody for one year but witness action till date has not commenced. Learned advocate for the State, on the other hand, submits that witness action would commence from 12.01.2026. Having considered the quantity of contraband seized, I am of the view Section 37 of the NDPS Act is attracted.

Accordingly, the bail application being CRM (NDPS) 1659 of 2025 is dismissed.

Petitioner would renew his prayer for bail after the evidence of the seizure list witnesses are completed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
