Petitioner is aggrieved by the fact that he is being threatened by the accused persons and/or their associates in connection with Kolaghat PS Case No. 315 of 2024 dated 16.04.2024.

In view of the nature of the allegations and the subject matter of the case which is under the provisions of Section 302 and section 394 of the Indian Penal Code, I direct that the learned Sessions Judge, 4th Court, Tamluk, Purba Medinipur would in the fitness of circumstances pass necessary directions under the Witness Protection Scheme, 2018 in order to protect the present petitioner and/or other witnesses who have been cited in the charge sheet by the prosecution.

Learned Sessions Court would take all steps in accordance with the guidelines laid down by the Hon'ble Supreme Court in the case of Mahendra Chawla vs. Union of India. If the accused persons are in custody and still they are able to create a circumstance, the threat perception of the present petitioner and/or his family members be analysed by the Superior Officer of Police and appropriate protection be granted to them so that they can give evidence in a free and fair manner before the court as and when called for.

With the aforesaid observations WPA 28693 of 2024 is disposed of.
