The petitioner is aggrieved by the non-consideration of her representation made for compassionate appointment on October 22, 2024 before the Respondent No.2 to the post of Muslim Marriage Registrar (MMR) and Kazi as her father who had been holding such post had become permanently disabled.

The respondents are represented.

Having heard the learned advocates appearing for the respective parties and having perused the material on record this Court is of the view that it will be useless to keep the instant writ petition pending and as such the same is disposed of by directing the respondent no.2 to consider and dispose of the representation made by the petitioner to the respondent no.2 on October 22, 2024 (which forms Annexure P-5 to the writ petition at pages 26 and 27 thereof).

Needless to mention that the respondent no.2 shall dispose of the said representation, after giving an opportunity of hearing to the petitioner, by a reasoned order which shall be communicated to the petitioner within a week of passing of such order.

The entire exercise shall be completed by the Respondent No.2 within a period of six weeks from the date of communication of this order.

It is made clear that this order directing the Respondent No.2 to consider the petitioner's representation shall not be deemed to be a mandate or a direction on the respondent no2 to grant a favourable decision in favour of the petitioner.

The respondent no.2 shall be free to take such decision as would be justified strictly in accordance with law.

With the aforesaid observations the writ petition being WPA 28689 of 2024 stands disposed of.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the learned advocates for the parties.
