Learned advocate appearing for the petitioner submits that another accused namely, Mofijul Mondal has been granted bail in CRM (NDPS) 909 of 2025, as such the petitioner may be extended the same privilege. Learned advocate submits that the subject matter of the case relates to recovery of 1200 bottles of phensedyl and the petitioner is in custody for about 10 months.

Learned advocate for the State opposes the prayer for bail and submits that the present petitioner is not similarly situated as the other accused person who has been granted bail.

I have taken into account the recovery was from the possession of the present petitioner and there was communication with another accused who is still at large. The earlier order itself reflects that Mofijul Mondal was no way connected with the offence and had been only plying the vehicle which an agent organized for him.

Having regard to the materials available in the Case Diary, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1639 of 2025 is dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
