At the time of hearing, learned advocate for the writ petitioner submits before this Court that the order under challenge in the instant writ petition is an appealable one.

2. He prays for withdrawal of the instant writ petition with a liberty to file an appeal before the appropriate forum.

3. Prayer for withdrawal of the instant writ petition is allowed.

4. In view of such, the instant writ petition being WPA 28929 of 2024 is thus disposed of as withdrawn.

5. Liberty is given to the writ petitioner to file appeal challenging the order under challenge in the appropriate forum.

6. Since the appellant is pursuing in a wrong forum on account of misconception, this Court directs the appellate authority i.e., the Divisional Commissioner, Medinipur Division not to treat the appeal as time barred and/or beyond period of limitation in the event, appeal is filed within 15 working days from today.

7. The Divisional Commissioner, Medinipur Division is directed to act on the server copy of this order. (Partha Sarathi Sen, J.)
