Learned advocate appearing for the petitioner submits that the petitioner has been implicated for alleged recovery of 800 bottles of phensedyl and is in custody for about seven months. As such, petitioner prays for bail on any stringent conditions.
Learned advocate for the State opposes the prayer for bail and submits that recovery was from the present petitioner and the other accused person was arrested on the basis of statements of co-accused.
I have taken into account the materials appearing against the petitioner and the quantum of seizure. Having regard to the same, I direct that the learned trial Court will release the petitioner on bail after the stage of
framing of charges are overcome by the learned Special Court on such terms and conditions as the learned Special Court deems fit and proper for ensuring the appearance further before the learned Special Court.
Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1641 of 2025 is disposed of.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
